This document contains the Terms and Conditions governing your use of this Website, Ortigas Cinemas online booking system, and the Ortigas Cinemas E-Ticketing system (hereto collectively referred to as the “Service”), your purchase of any Ortigas Cinemas movie tickets, goods or services from Ortigas Commercial Corporation (formerly Capitol Commons Corp.), hereinafter referred to as the “Company”, through the Service, and participation in any competition organized by the Company on this Website. If you do not agree to these Terms and Conditions, do not use or access the Service. The Company reserves the right to change these Terms and Conditions from time to time and at its sole discretion. Your continued use of the Service following the posting of any changes to the Terms and Conditions constitutes your acceptance of such changes. We strongly recommend that you review the Terms and Conditions whenever you use this Website and prior to your use of the Service. You can review the most current version of these Terms and Conditions at any time. "Use of the Service” shall include, but is not limited to, accessing or browsing the Website and the Website Content, as hereinafter defined, registering for an account or your devices, purchasing tickets electronically, and other transactions made through the Service.

Disclaimer


The Company is providing this facility as an alternative mode of purchasing movie ticket(s) and other related goods and services, as may be made available by the Company based on the sole discretion of the Company, and makes no representations or warranties of any kind, express or implied, with respect to this Website or the information, content, products or services included in this site. In no circumstances shall the Company or any of its officers or employees be liable for any loss, additional costs or damage as a result of any use of this facility.

The Company does not warrant that the Service will (1) be uninterrupted; (2) be free from inaccuracies, errors, viruses or other harmful components; (3) meet your requirements; or (4) operate in the configuration or with the hardware or software you use. If you are dissatisfied with the Service or any content on the Website, or with these Terms and Conditions, your sole and exclusive remedy is to discontinue using the Service and, if applicable, delete your account. You acknowledge, by your use of the Service, that your use is at your sole risk.

In the event any applicable law does not allow the limitation of liability set forth above or any part of this limitation on liability is found to be invalid or unenforceable for any reason, then the aggregate liability of the Company under such circumstances for liabilities that otherwise would have been limited and shall not exceed the price you paid for the purchase via the Service.

Permitted Use


The Service is for your personal and non-commercial use. Unless otherwise agreed to in writing by the Company, you agree that you will not use the Service or duplicate, download, publish, modify or otherwise distribute or use any material included in the Service for any purpose, except to review the information included in the Service, to subscribe to programs included in the Service, and to purchase movie or other event tickets, or other products offered by the Company for your personal use. You also agree that you will not link to any page on the Service other than the Company's home page for the Service, without the Company's prior written consent. Use of the Service or the materials or content contained in the Service for any purpose not set forth in these Terms and Conditions is prohibited and may subject the user to criminal prosecution under Philippine laws.

Copyrights and Proprietary Rights


You acknowledge and agree that the copyright and other intellectual property rights in the Service and in all information and materials on this Website ("Website Content") are owned by the Company, its parent company, affiliates, and subsidiaries (the “Ortigas Group”), and/or its suppliers or licensors unless otherwise expressly indicated. The Website Content is protected by Philippine and international copyright and trademark laws.

You agree that you will not do any of the following without the Ortigas Group's written permission:

  • use the Ortigas Commercial Corporation's trademarks and those trademarks appearing through the Service which are registered and/or owned by any other member of the Ortigas Group or Ortigas Group’s content suppliers, except for those included in an unaltered printed copy of this Website or as part of a reference to an Ortigas Cinemas product or service, provided that such reference shall not in any way besmirch the reputation of Ortigas Cinemas and/or any of the member of the Ortigas Group;
  • reproduce, copy, modify, merge, adapt, translate, re-publish, frame, upload to a third party, post, transmit, broadcast, communicate to the public or otherwise make the Website Content available to the public;
  • transmit or display the Website Content on any computer, system or network which permits electronic access by more than one user at a time;
  • use, sell, assign, rent, sub-license or otherwise deal with the Website Content except as permitted by the Terms and Conditions; or
  • anything else which would infringe the Company's rights or the rights of any member of the Ortigas Group or any of the Website's content suppliers.

You may view this Website using a web "browser" so long as you do not change the form of copyright and other proprietary notices. If you are interested in a piece of content solely for your own personal and non-commercial use, you may save a single copy, print one or download one.

Purchases


Each movie ticket admits one person. The price of movie tickets may be changed by the Company without prior notice. MTRCB, Season Pass, Complimentary Pass, Production Pass, Senior Citizen ID, and PWD ID are not honored for online transactions. All privileges that involve an ID card, such as the Senior Citizen ID and PWD ID are only valid for purchase at Ortigas Cinemas ticket booths for verification purposes.

Movie tickets purchased via the Service are strictly non-cancellable and are not available for exchange under whatever circumstances. Refunds will be provided only when the movie itself has been canceled/re-scheduled, or if the cinema(s) concerned will not be operating on the date stated in the purchased movie ticket for any reason whatsoever. Refunds will be coursed thru the respective medium by which you bought the tickets (credit card/debit card/other such payment channels as may be made available by the Company through the Service) and is subject to the rules and regulations of the third-party payment gateway, the financial institution, and/or other service providers, as the case may be.

The Company reserve the right to limit quantities of the movie tickets that you may buy.

In no event will you be charged for access or use to all or portions of the Service unless the Company obtains your prior agreement to pay such charges.

You shall pay all fees and charges incurred through your account at the rates in effect for the billing period in which such fees and charges are incurred, including but not limited to charges for any products or services offered for sale by or through this Website or by any other vendor or service provider. All fees and charges shall be billed to you, and you shall be solely responsible for their payment. You shall pay all applicable taxes relating to the use of the Service through your account, and your purchase of any other products or services through the Service.

Movie tickets are made available subject to the classification of the relevant film given by the Movie and Television Review and Classification Board (MTRCB). In purchasing movie tickets via the Service, you confirm that you are aware and knowledgeable about the MTRCB rating of the movie corresponding to your movie ticket. You agree that it is your responsibility to ensure that movie tickets are only provided to age-appropriate persons. You also agree and understand that the Company has the right to ask for a valid ID of a customer if the MTRCB rating has established a certain age limit or to determine whether the customer is eligible for a discount ticket and that the Company has a legal obligation to refuse admission to the movie theatre of any person, who in the opinion of its manager, is under the minimum age required based on the corresponding MTRCB rating of such movie, even if such person is accompanied by an adult. No refund shall be granted in the event of any denial of admission based on the customer’s failure to comply with the foregoing requirements.

You represent and warrant that (a) any personal information, including your financial information and credit/debit card information, you supply is true and complete; (b) charges incurred by you will be honored by the issuing credit/debit card company; and (c) you will pay the charges incurred by you at the posted prices, including any applicable taxes.

If the credit/debit card used for payment is issued in the name of a third party, you certify that said third party has granted specific authorization to use such credit/debit card for this transaction. The Company reserves the right to cancel the transaction, in the exercise of reasonable discretion, if it is determined that the payment has been done fraudulently, unlawfully, or without proper authorization, and you shall indemnify and hold the Company, as well as any and all the other members of the Ortigas Group, free and harmless from any claim or liability in connection therewith.

All payments are subject to the terms and conditions of each bank and the Company has no authority over any payments made through the bank payment gateway. In using your bank-issued credit card/debit card, you agree to abide by the terms and conditions imposed by your card’s issuing bank, as well as those imposed by the bank payment gateway.

The Company does not retain your payment details or any other significant information such as your complete credit/debit card number, passwords, pin number etc. As the cardholder of a credit/debit card, you understand that you are solely responsible for securing your credit/debit card. Once your credit/debit card is used to purchase a movie ticket via the Service, you agree to hold the Company indemnified and free and harmless from any claims, liability, charges, costs, and expenses incurred by the use of your card to purchase movie tickets via this Service. Details of your credit/debit card may be securely held by the bank which processes your transaction.

Upon completion of purchase through the service, you will receive a voucher containing the transaction ID, receipt ID, number of movie ticket/s that you purchased, and the corresponding cinema seat of such purchased ticket/s, as applicable. You will need to present this voucher to redeem the physical movie ticket from the ticket booth or other authorized redemption sites listed in the website.

To enter the relevant cinema on the date and time stated in the purchased movie ticket, you will need to present your physical movie ticket to the cinema porter of such cinema. If the Company utilizes a barcode reader to verify its customers’ voucher/s, your voucher shall be treated as your physical movie ticket, provided that the cinema porter successfully verifies the barcode on your voucher.

The Company may require the customer to produce / present / submit documents to prove validity of the online movie ticket purchase transaction, including but not limited to the physical credit/debit card used for the transaction, authorization letter from card holder allowing another person to redeem tickets on his / her behalf, any certification or document proving that Purchaser is eligible to use a corporate issued card, valid ID’s of card holder and / or third party redeeming tickets on behalf of the card holder, duly signed online ticket voucher, among others.

You are responsible for safekeeping your voucher and, once collected, your physical movie ticket. It is your responsibility to protect your voucher as redemption may only be done once and any succeeding attempt to redeem movie tickets purchased online using such voucher will be denied. The Company shall not be responsible for any movie ticket released to a person, provided that such person presented the corresponding voucher. Neither shall the Company replace any lost or stolen collected physical movie ticket.

Movie tickets purchased via the Service are redeemable only until the screening time and duration of the movie for which the ticket was purchased. Once screening time has lapsed, the movie ticket purchased online will be considered unredeemable from both the cinema porter and ticket booth. Reserved Seating and Guaranteed Seating Ticket are not valid when the selected screening time has passed.

Ortigas Cinemas Rules and Regulations


In redeeming the movie tickets and availing of any movie screening offered by the Company at Ortigas Cinemas, you agree that you are bound by the applicable laws, rules and regulations, as well as any and all rules and regulations implemented by the Company, the Mall Management, and/or its Ortigas Cinemas Manager governing, among others, movie ticket purchasing and redemption, movie scheduling and screening, and other services offered by the Company. The Company reserves the right to change such Ortigas Cinemas rules and regulations from time to time and at its sole discretion. GUESTS WHO VIOLATE THE ORTIGAS CINEMAS RULES AND REGULATIONS ARE SUBJECT TO EXPULSION OR IN CASE OF A SERIOUS OFFENCE, THE VIOLATOR WILL BE HANDED OVER TO THE HIGHER AUTHORITY.

Ortigas Cinemas Privacy Policy


By using the Service, you understand that the Service is bring provided by Ortigas Cinemas, and your data is being processed by and for the Ortigas Group pursuant to its Data Privacy Policy. You hereby agree to abide by the Data Privacy Policy of the Ortigas Group.

By providing your personal data and submitting your information through the Service and/or this Website, you consent to (a) the collection, use, disclosure and/or processing of your personal data by the Ortigas Group, their agents and their authorized service providers, in order to process the Service and/or respond to your request, query, feedback or comments; and (b) the Ortigas Group’s Data Privacy Policy. You hereby consent to the use and disclosure of your personal data for the purpose of helping each member of the Ortigas Group review and improve its products and services (including conducting market research and data analytics).

You also consent to receive information about Ortigas Group’s products and services, promotional offers, contests, newsletters or other activities that may be of interest to you. You understand that the Ortigas Group will respect your wishes if you elect not to receive future correspondence about these activities. With each communication you receive, you will have the opportunity to indicate if you do not want to receive future communications.

Change or Suspension of Site


We reserve the right to modify or discontinue, temporarily or permanently, the Service, this Website or any part of this Website with or without notice. You agree that we shall not be liable to you or any third party for any modification, suspension or discontinuance of the Website and / or any Service governed by these Terms and Conditions, for any reason. We do not guarantee continuous, uninterrupted or secure access to our Service, and operation of our Website, including payment and/or confirmation services, such as the bank payment gateway or the SMS provider, which may be interfered with by numerous factors outside of our control. In addition, the Service, including the Website and/or the corresponding payment and/or confirmation services, such as the bank payment gateway or the SMS provider, could be unavailable during certain periods of time while it is being updated and modified. During this time, the Service, the Website and/or its payment and/or confirmation services, such as the bank payment gateway or the SMS provider, as the case may be, will be temporarily unavailable. We shall not be made liable for any discomfort or prejudice which you have suffered as a result of these circumstances.

You acknowledge and agree that Linked Sites are not under the control of the Company and that the Company is not liable or responsible for:

  • any act, omission or negligence of any person who administers or owns any Linked Site;
  • the copyright compliance, legality or decency of any Linked Site;
  • the accuracy or reliability of any information provided by any Linked Site;
  • any goods or services provided by any person who administers or owns any Linked Site;
  • the performance of any obligations owing to by any person who administers or owns any Linked Site; or
  • the contents of the Linked Site including if any such content is considered by the user as annoying, scandalous, or contrary to his values and beliefs.

Breach of these Terms and Conditions


If you breach any of the Terms and Conditions, you may no longer avail of the Service and may be denied use of this Website. The Company may, in its sole discretion, cancel or terminate your right to use the Service or any part of thereof, at any time without notice. In the event of such cancellation or termination, you are no longer authorized to access this Website or that part affected by such cancellation or termination. In such event, the restrictions imposed upon you by these Terms and Conditions shall still apply. The Company shall not be liable, obligated or otherwise responsible to any party for damages arising from such a cancellation or termination. The Company reserves the right to seek all remedies available to it at law and in equity for violations of the Terms and Conditions.

The Service may be accessed from countries around the world, other than the Philippines, and may contain references to products, services, and programs that have not been announced and are not available in your country. These references do not imply that the Company intends to announce or make available such products, services or programs in your country. This Service is not intended for use or distribution by any person in any jurisdiction where such use or distribution is contrary to local law or regulation.

The Company makes no representation or warranty that the Website Content is appropriate, available for use or legal in countries, territories or lands other than the Philippines. The Company makes no representation or warranty that accessing this Website and/or using the Service from countries, territories or lands other than the Philippines is not prohibited. Those who choose to access this Website and/or use the Service from countries, territories or lands other than the Philippines do so entirely on their own initiative and entirely at their own risk, and they are solely responsible for the consequences of same, and for compliance with their local laws.

Governing Laws


These Terms and Conditions shall be construed in accordance with and shall be governed by the laws in force in the Philippines.

Indemnification


You agree to defend, indemnify and hold harmless the Company and the Ortigas Group from any and all liabilities, claims, expenses or demand, including reasonable attorneys' fees, made by any third-party due to or arising: (1) from your use or misuse of or your connection to this Website and/or the Service; (2) out of User Content you submit, post to or transmit through the Company’s Website or service, (3) from your violation of these Terms and Conditions, or (4) your violation of any rights of another. You agree to pay any and all costs, damages and expenses, including, but not limited to, reasonable attorneys' fees and costs awarded against or otherwise incurred by or in connection with or arising from any such claim, suit, and action or proceeding attributable to any such claim. The Company reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with the Company in asserting any available defenses.

Dispute Resolution


You agree that any causes of action arising out of or related to these Terms and Conditions or your use of the Website or your use of the Service must formally commence within one (1) year after the cause of action arises, otherwise such cause of action is permanently prohibited.

Your use of this Website and/or the Service constitutes your acknowledgement that you have read these Terms and Conditions, the Ortigas Cinemas Privacy Policy and all the applicable Ortigas Cinemas rules and regulations, and that you understand the nature and consequences of same, and agree to be bound by all of the terms, conditions and provisions contained therein.
